Special conditions for sale of electricity by nominated electricity trading undertaking to business operators (rev)

These conditions relate to the sale of electricity to business operators who have had an electricity trading undertaking nominated by the electricity network undertaking pursuant to Chapter 8 of the Electricity Act (1997:857).

1a. Commencement of the supply and conclusion of contract when the installation is not connected

The supply of electricity will commence immediately when the electricity user confirms that they accept the conditions for the supply and the reasonable collateral that may when appropriate be requested. This contract applies from the commencement of the supply of electricity unless special collateral is requested. In the latter case, the contract applies from when the requested collateral has been received.

The collateral requested must have been received no later than five working days after the commencement of the supply.
The electricity supply may be immediately discontinued if the collateral requested has not been received within five working days.

1b. Regulation of supply when the installation is connected

If the transmission of electricity has not been discontinued and the electricity user starts to take out electricity without there being a supply contract, the user is according to the Electricity Act nonetheless liable to pay for the electricity to the nominated electricity trading undertaking in accordance with the conditions such undertaking applies.

When the electricity trading undertaking has become aware that there is an electricity user who takes out electricity, the electricity trading undertaking shall immediately send out the conditions for the supply with, when appropriate, the request for collateral to be provided. The contract applies from when the electricity user received the conditions unless special collateral has been requested. In the latter case, the contract applies from when the requested collateral has been received.

If collateral is requested in accordance with EL 2012 N (rev), Clause 4.3, it must have been received no later than five working days after the electricity user has been notified that collateral is requested.

The provisions referred to in 1a., third paragraph, apply if the collateral has not been received within the time specified.

2. Precondition for supply

It is a precondition for the supply of electricity that the electricity user’s installation is not disconnected owing to default in payment or another breach of contract in relation to the electricity network undertaking.

3. Prices

Prices for electricity supplied are shown in the attached price schedule.

4. Reconnection

If the electricity user has committed a fundamental breach of contract in relation to the nominated electricity trading undertaking and the electricity user’s installation has been disconnected in accordance with the provisions contained in EL 2012 N (rev), Clause 5.1, the following provision applies.
Reconnection will only be made when the electricity user has satisfied all of their obligations under the contract and paid reasonable compensation to the nominated electricity trading undertaking for the costs caused by measures taken for disconnection and reconnection.

The General Conditions EL 2012 N (rev) otherwise apply in appropriate respects
